In ’n gesamentlike skrywe van die Thabazimbi Sakekamer en die Thabazimbi Belastingbetalersvereniging, gerig aan die besighede en inwoners van Thabazimbi, word meer agtergrond aangaande die huidige status van die regsaksie verskaf.

Die brief lui as volg:

Soos u weet is daar Vrydag, 10 November 2017 ‘n ‘tussentydse ooreenkoms’ tussen Eskom en die Munisipaliteit bereik en is kragvoorsiening Vrydag-aand weer herstel. Die enigste detail van die ooreenkoms tot ons beskikking is soos dit vervat was in daardie Vrydag se media verklaring van die Munisipaliteit. Ons weet wel dat daar Dinsdag, 14 November 2017 ‘n betaling deur die Munisipaliteit aan Eskom in lyn met die ooreenkoms, gemaak is.

Die ooreenkoms tussen die partye spreek egter nie die feit aan dat Eskom ter enige tyd weer kennis kan gee van onderbroke voorsiening en sodoende die gemeenskap weer in ‘n situasie van dringendheid dompel nie.

Die status van regsaksie is soos volg:

20/21 November – Eskom lewer repliek en staan dringende aansoek ten sterkste teë
21 November – Vergadering met ons regspan om ons repliek op Eskom se repliek te lewer (deel van ons repliek was die meer as 100 verklarings deur besighede en die publiek dat rekeninge van die wat ons verteenwoordig tot op datum betaal is).
23 November – Inhandiging van dokumente aan hof ter voorbereiding van die aanhoor van die saak
28 November – Die saak sal aangehoor word in die hof en op grond van die regter se uitslag sal volgende stappe bepaal word

Verder moet ons u ook inlig dat ons huidige fondse om die saak deur te sien nie genoegsaam is nie. Ons vra weereens vir u oorweging om ‘n bydrae tot die trustfonds wat die saak finansier te maak. Ons is ewig dankbaar vir elke bydrae, en ons glo u kan sien dat die pogings reeds verandering teweegbring, maar ons kan nie ons aksies nou stop nie. Ons gemeenskap se situasie is nog ver van stabiel af:

Soos in elke vorige kommunikasie aan u uitgelig, sal die Thabazimbi Sakekamer en Thabazimbi Belastingbetalersvereniging steeds ‘n parallelle aksie dryf om die Thabazimbi Munisipaliteit, Provinsiale regering en Eskom om een tafel te kry om hoër-vlak finansiële ondersteuning te bespreek en verdere aksies teweeg te bring om die krisis te bestuur.

DSC_3955Medhof Apteek het R500 bygedra tot hierdie verdienstelike saak. “Kan almal asseblief ons voorbeeld volg? Ons kan nie bekostig dat Eskom ons so manupuleer nie. Waarom moet ons gestraf word as ons niks verskuldigis nie. –  Ons Moet  Wen!”

 

 

 

 

In a joint letter from the Thabazimbi Chamber of Commerce and Thabazimbi Tax Payers Association, addressed to Thabazimbi Business Owner and residents, background is supplied concerning the status of the ongoing legal action.

The letter reads as follows:

As you know, on 10 November 2017 an ‘interim agreement’ was reached between Eskom and the Municipality and electricity supply restored on Friday evening. The only detail of the agreement to our disposal was as stated in the municipality’s media statement that Friday. We do know that a payment by the Municipality to Eskom in line with the agreement was made on Tuesday, 14 November 2017.

However, the agreement between the parties does not speak to the fact that Eskom may at any time give notice of interrupted supply again, thus dumping the community back into a situation of urgency.

The status of the legal action is as follows:

20 /21 November – Eskom delivered their reply objecting in the strongest sense against the urgent application
21 November – Meeting with our legal team to draft our reply to Eskom’s reply (part of our reply is the more than 100 statements by businesses and the public to show that the accounts of those that we represent are paid to date).
23 November – Submitting documents to the court in preparation of the hearing of the case
28 November – The case will be heard by the court and based on the ruling by the judge the next steps will be decided

Furthermore, we must also inform you that our current funds to see the case through will not be enough. We again ask for your consideration to make a contribution to the trust fund that is financing our case. We are eternally grateful for every contribution made and we believe that you can see the change these efforts are bringing, but we cannot stop our actions now. The community’s situation is far from stable.

As highlighted in all previous communications, the Thabazimbi Business Chamber and Rate Payers Association will continue to drive a parallel action to get the Thabazimbi Municipality, Provincial Government and Eskom around one table to discuss higher-level financial support and generate further actions to manage the crises.
